However, Assistant Oakland Prosecutor Robert Novy said Tuesday during a court hearing, "We've amended to open murder so that we can argue our theories."Solinski-B lain was pregnant when shot to death last October outside the Rib Rack restaurant in Lathrup Village where she worked as a manager. Police believe robbery was the motive."I've been praying for the family that lost their daughter ... However, I know for sure my son is definitely not a murderer. He's a good kid," said Jerome Hamilton, Sr.Also charged in the case is 20-year-old Brandon Davis of Southfield. He's accused of conspiracy to commit robbery and being an accessory after the fact. 19-year-old Deandre Sturges of Beverly Hills is charged with open murder.Hamilton was 15 at the time of the murder and is the suspected triggerman. However, Hamilton's lawyer, Arnold Weiner, said no physical evidence links him to the crime.The prosecutor said Hamilton bragged about being a member and recruiter for the Crips street gang. "The characterization was embellished greatly. Growing up in the inner city of Detroit, as we know it's a tough environment and there have been times when people tried to recruit my son to things and that hasn't happened," Hamilton's father said.The judge denied bond for Hamilton, but refused a prosecution request to move him from the Oakland County Children's Village to the Oakland County Jail. I want everyone to take this to heart. I hope that it sinks in.- To all of you who think you have a clue, but don't,Enough is enough. The inner workings of this band are absolutely nobody's business but our own. NONE of you have even the slightest idea what goes on in our everyday lives or what it takes to keep this band moving forward in a positive direction. There is not a singe Shinedown band member who hasn't sacrificed everything, our health, our sanity, and personal relationships, to be able to do what we do and bring our music and our art to you all. Especially Brent Smith and Barry Kerch! I know that Zach would agree with me in saying that these two people are our brothers. They are two of the kindest, most giving people I have ever known. Brent Smith would give any of you the shirt off of his back with a smile, and still not feel like he had done enough. I owe him everything I have. Barry Kerch is my partner in crime. He has been there to see me through one of the toughest times in my life. He is one of the best and kindest souls I know. Zach Myers has become the little brother that I never had. He is not, and never has been the conniving, calculating person that you all try and make him out to be. He's just a regular guy who loves being on stage playing rock and roll guitar for you all every night. When you attack these people you attack me. This band is my family first and foremost. When you come after one of them, you come after me. I dare any one of you to find me after a show and spew your ridiculous insults and minutia to my face. I FUCKING DARE YOU!!!! Somehow I have managed to keep this to myself for the past year, but not anymore. I am calling all of you out. I want to see your faces, not just a "code name" on a message board or on myspace. Stop hiding. I owe my life to Brent Smith, Barry Kerch, and Zach Myers. They have never wronged any member of this band past or present, and they surely haven't wronged and of you. They have kept their mouths shut about their family business, because that's what it is...FAMILY BUSINESS. There are no "puppet masters" in this band. The history between Brent, Barry, Zach, Jasin, and Brad is their business and theirs alone. Most, if not all of you will never know the true story. And you know what, that's exactly the way it should be. And as much as it pains you, it is absolutely none of your business. In closing I will say this. The only thing that Brent, Barry, and Zach have done is bleed and sweat for you all 200 nights a year, then willingly give you their time after every show with a smile, a handshake, and a hug. You should all be ashamed of yourselves. You have twisted and distorted what being a true fan is, and have managed to throw your favorite band under the bus.
